The Ontario Physicians and Surgeons Discipline Tribunal (OPSDT) is a neutral, independent, administrative tribunal that adjudicates allegations of professional misconduct or incompetence of Ontario physicians made by the College of Physicians and Surgeons of Ontario. The Tribunal is made up of physicians, non-physician members of the public and experienced adjudicators and holds hearings in a trial-like process. Dr. Jean-Marc Benoit #83720
On January 30, 2024, the Tribunal found that Dr. Benoit engaged in disgraceful, dishonourable or unprofessional conduct in that he failed to cooperate with the College’s investigation, including by failing to provide information in response to written inquiries. Read more.
Dr. Crystal S. Luchkiw #97606
On July 6, 2023, the Tribunal found that Dr. Luchkiw engaged in disgraceful, dishonourable or unprofessional conduct, failed to respond appropriately or within a reasonable period of time to a written inquiry from the College and failed to cooperate with its investigations into her conduct, communications and infection control practices in relation to COVID-19.
The Tribunal also found that Dr. Luchkiw contravened a term, condition or limitation on her certificate of registration by breaching the terms of an interim order made under s. 25.4 of the Code. Read more.
Dr. Javad Peirovy #84832
On September 29, 2023, the Tribunal found that Dr. Peirovy engaged in disgraceful, dishonourable or unprofessional conduct and contravened a term, condition or limitation on his certificate of registration by engaging in professional encounters with female patients outside the presence of a female Practice Monitor acceptable to the College; failing to maintain a log of all female patients; and failing to post a sign in all his waiting rooms and each of his examination and/or consultation rooms, all of which were required by the Discipline Committee’s order made in 2016. Dr. Gary Alan Rosenthal #57790
On February 5, 2024, the Tribunal found that Dr. Rosenthal engaged in sexual abuse and disgraceful, dishonourable or unprofessional conduct by touching Patient A in a sexual manner during a medical appointment and having a sexual relationship with Patient B while continuing to treat her. Read more.
Dr. Mark Raymond Trozzi #62778
On October 6, 2023, the Tribunal found that Dr. Trozzi committed professional misconduct by:
- engaging in disgraceful, dishonourable or unprofessional conduct and failing to meet the standard of practice of the profession in relation to his statements about vaccinations, treatments and public health measures for COVID-19 in social media postings, on his website and in interviews;
- failing to meet the standard of practice of the profession in his care of patients to whom he issued medical exemptions from COVID-19 vaccines; and
- failing to respond appropriately or within a reasonable time to a written inquiry from the College

Dr. Caroline Anne Turek #62448
On December 15, 2023, the Tribunal found that Dr. Turek engaged in disgraceful, dishonourable or unprofessional conduct in relation to her communications on her publicly available social media accounts and other online forums regarding the COVID-19 pandemic and related issues. Read more.
