



Below are summaries of recent decisions of the Ontario Physicians and Surgeons Discipline Tribunal (OPSDT).

Dr. Ajeet Singh Sidhu – CPSO #123011

Speciality: No Specialty Reported
On May 6, 2025, the Tribunal found that Dr. Sidhu engaged in professional misconduct by settling an allegation with a health profession regulator outside of Ontario, which constitutes professional misconduct or incompetence under Ontario legislation.
The Tribunal’s finding was based on records from the Medical Board of California, which had filed an Accusation alleging that Dr. Sidhu engaged in sexual misconduct with a patient while practising in that jurisdiction. To resolve the pending discipline proceedings, Dr. Sidhu voluntarily entered into a Stipulated Surrender of License and Order, surrendering his certificate to practice in California.
Penalties:
- Reprimand
- Suspension for ten (10) months commencing May 7, 2025 at 12:01 a.m.;
- Terms, conditions and limitations on Dr. Sidhu’s certificate of registration; and
- Pay the College costs of $6,000 by June 4, 2025.

Dr. Sonja Sophia Kustka – CPSO #53928

Specialty: No Specialty Reported
In its reasons for decision released March 5, 2025, the Tribunal found that Dr. Kustka, in her failure to cooperate with the College’s investigation and by breaching the terms of an interim order made under section 25.4 of the Health Professions Procedural Code:
- Engaged in disgraceful, dishonourable or unprofessional conduct;
- Failed to respond appropriately or within a reasonable time to a written inquiry from the College; and
- Contravened a term, condition or limitation on her certificate of registration.
The panel’s reasons for decision on penalty were released on June 17, 2025.
Penalties:
- Reprimand
- Suspension commencing at 12:01 a.m. on June 18, 2025, and continuing until the later of:
- Four months from the date of this order;
- The date that Dr. Kustka provides the following information and documents, without redaction and to the College’s satisfaction:
- Physician Practice Questionnaire and Electronic Records Questionnaire;
- A list of all patients to whom she has:
- Provided COVID-19 related medical exemptions (Vaccine, Masks, Testing)
- Prescribed Ivermectin
- A complete copy of each identified patient’s medical record;
- Consent to make appropriate inquiries to OHIP to monitor her compliance with the Interim Order
- A log of all professional encounters with patients (“the Patient Log”).
- Revocation of Dr. Kustka’s certificate of registration on a date set by the Registrar if:
- Six months have passed since the initial four-month suspension period or since any appeal rights have been exhausted, whichever comes later; and
- Dr. Kustka remains suspended under this order.
- Pay the College costs of $39,295 by July 17, 2025.

Dr. George John Polemidiotis - CPSO #67955

On June 3, 2025, the Tribunal found that Dr. Polemidiotis engaged in professional misconduct by:
- Engaging in sexual abuse of Patients A and B, which also constituted disgraceful, dishonourable, or unprofessional conduct;
- Being found guilty of an offence relevant to his suitability to practise, having been convicted of three counts of sexual assault under s. 271 of the Criminal Code of Canada, involving three patients, including Patient A.
The Tribunal also found that Dr. Polemidiotis engaged in disgraceful, dishonourable, or unprofessional conduct and conduct unbecoming a physician based on the conduct underlying the criminal charges and convictions.
Penalties:
- Reprimand;
- Revocation effective June 4, 2025 at 12:01 a.m.; and
- Pay the College costs of $6,000 by July 3, 2025.

Dr. Mehdi Horri – CPSO #87715

Specialty: Family Medicine
On June 2, 2025, the Tribunal found that Dr. Horri committed professional misconduct based on a prior finding by the College of Physicians and Surgeons of Saskatchewan (CPSS), which related to a breach of an undertaking. Dr. Horri breached the CPSS undertaking by having a professional encounter with a four-year-old female patient, contrary to the condition requiring that a female monitor be present for all female patient encounters.
The Tribunal found that the misconduct established by the CPSS would also constitute professional misconduct under section 51 of the Code. In addition, the Tribunal found that by breaching the CPSS undertaking, Dr. Horri engaged in disgraceful, dishonourable, or unprofessional conduct.
The Tribunal further found that Dr. Horri failed to report two criminal charges made by the Saskatchewan Police: one in September 2023 for dangerous driving, and another in March 2024 for sexual assault. Both charges were later stayed. Dr. Horri’s failure to report these charges constituted disgraceful, dishonourable, or unprofessional conduct.
Penalties:
- Reprimand;
- Suspension for twelve (12) months commencing June 3, 2025, at 12:01 a.m.; and
- Pay the College costs of $6,000 by July 1, 2025.

Dr. Cholemkeril Kuncheria Thomas - CPSO#54092

Specialty: Family Medicine (Emergency Medicine)
On July 15, 2025, the Tribunal found that Dr. Thomas committed professional misconduct in that he:
- engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable, or unprofessional; and
- was found guilty of an offence relevant to his suitability to practice.
These findings arose from Dr. Thomas’s breach of an Undertaking with the Ontario Provincial Police, which prohibited him from communicating with the complainant in a sexual assault charge. Dr. Thomas pleaded guilty to failing to comply with a condition of the Undertaking, contrary to section 145(4)(a) of the Criminal Code of Canada, by communicating with the complainant. Dr. Thomas received a Conditional Discharge and was placed on one year of probation. Upon successful completion of the probationary period, the discharge became absolute on May 12, 2023.
Penalties:
- Reprimand;
- Suspension for six (6) months, to commence August 26, 2025 at 12:01 a.m.; and
- Pay the College costs of $6,000 no later than one year from the date of this order.
